Children’s Privacy Notice

1 | INTRODUCTION AND OVERVIEW. Vision Media Management & Fulfillment, LLC (“Vision Media,” “we,” “our” or “us“) operates an online service that is not intended for children and is not targeted to children under age thirteen (13). Vision Media does not knowingly collect personal information as defined by the Children’s Online Privacy Protection Act (“COPPA“) from children under the age of thirteen (13) (“child” or “children“), except as may be permitted by COPPA and explained in this Children’s Privacy Notice.  If you are a parent or guardian and believe that we have collected such personal information other than as permitted by COPPA, please contact us at privacy@visionmedia.com.

2 | CHILDREN’S USE OF OUR SERVICE. Our online service is restricted to individuals who are members of a guild, union, trade association, or other organization participating in the specified voting-based awards program (“Voting Group Member“).  While most Voting Group Members are age thirteen (13) or older, some are children.  As such, prior to using our online service, we require all users to input a personal identification number provided by a guild, union, trade association, or other participating organization and associated with a particular Voting Group Member (“PIN“).  When a user inputs a PIN associated with a Voting Group Member under age thirteen (13), or when a user otherwise indicates that he/she is under age thirteen (13), we will, consistent with COPPA, require and obtain verified parental consent before we collect, use, or disclose any personal information from that Voting Group Member.

You understand and agree that the guilds, unions, trade associations, and other participating organizations, and not us, are responsible for associating PINs with Voting Group Members, including for Voting Group Members under age thirteen (13).  In the event that we become aware that we have collected personal information from any child without parental consent, we will dispose of that information or otherwise treat it in accordance with COPPA and other applicable laws and regulations.

3 | TREATMENT OF CHILDREN’S INFORMATION. Where we obtain verified parental consent, our online service collects, uses, and discloses children’s information in the same manner as it does other information as set out in our Privacy Policy. For example, our online service may automatically collect information about your child, such as his/her location and viewing habits.  Our online service may use and disclose the information we collect for purposes such as improving our online service, research and analysis, and protecting our online service and content.

In certain circumstances, we may need to transmit or display to others your child’s personal information along with information pertaining to his/her viewing habits of video content, in accordance with our Video Privacy Notice and Consent.

4 | PARENTAL CHOICES AND CONTROLS.  At any time, parents and legal guardians can refuse to permit us to collect further personal information from their children and can request that we delete from our records the personal information we have collected in connection with those children. Parents can request access to, change, or delete their child’s personal information by contacting us at privacy@visionmedia.com. To protect children’s privacy and security, we will take reasonable steps to help verify a parent’s identity before granting access to any personal information.  In the event a parent or legal guardian revokes consent, we will terminate their child’s access to our online service and we will not collect use, or disclose any further personal information from that child.
